Terms of Service

1. Grant of License

JimmyLabs grants you a limited, non-exclusive, non-transferable license to download and use HERE for personal, non-commercial purposes, subject to these Terms and all applicable laws.

2. User Eligibility

• You must be at least 18 years of age to use HERE
• By using HERE, you represent and warrant that you are 18 or older
• If you are under 18, you must not use HERE
• We reserve the right to verify age and terminate accounts of underage users

3. Account Responsibility

3.1 Account Creation

• You are responsible for maintaining the confidentiality of your account credentials
• You are fully responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We are not liable for any loss resulting from unauthorized account access

3.2 Account Information

• You must provide accurate, complete, and current information
• You must not impersonate any person or entity
• You must not create multiple accounts to circumvent restrictions
• You are responsible for updating your account information

4. Prohibited Conduct

You agree NOT to use HERE for any of the following activities:

4.1 Illegal Activities

• Violating any applicable laws or regulations
• Engaging in harassment, threats, or abusive behavior
• Sharing content that infringes intellectual property rights
• Distributing malware, viruses, or harmful code

4.2 Inappropriate Content

• Sharing sexually explicit, graphic, or obscene content
• Sharing content that exploits or endangers minors
• Sharing hate speech or discriminatory content
• Sharing content promoting violence or self-harm

4.3 Fraudulent Activity

• Scamming or attempting to deceive other users
• Using fake or misleading profile information
• Attempting to gain unauthorized access to accounts
• Engaging in credit card fraud or unauthorized transactions

4.4 Spam and Harassment

• Sending unsolicited messages or spam
• Engaging in harassment or bullying
• Posting repetitive, unwanted content
• Attempting to solicit personal information inappropriately

4.5 System Abuse

• Attempting to hack or reverse-engineer the app
• Disrupting server operations or network access
• Automating user interactions (bots, scripts)
• Bypassing security mechanisms or restrictions

5. User Content

5.1 Your Responsibility

• You are solely responsible for content you create, upload, or share
• You must have the rights to share all content you post
• You warrant that your content does not violate anyone's rights
• You agree to comply with all applicable laws regarding content

5.2 Our License to Your Content

• By posting content, you grant HERE a worldwide, royalty-free license to use, store, and display your content
• We may use your profile information and messages for service operations
• We will not sell your content to third parties

5.3 Content Removal

• We may remove any content that violates these Terms at any time
• We may disable accounts that repeatedly post prohibited content
• Users can block other users to prevent future contact

6. Credit System & In-App Purchases

6.1 Credits

• Credits are virtual currency used to send first messages to new users
• Each message to a new user costs 60 credits
• Subsequent messages to the same user do not cost credits
• Credits are non-refundable once purchased

6.2 In-App Purchases

• All in-app purchases are processed through Apple StoreKit
• Purchases are final and non-refundable, except as required by law
• Refund policies are governed by Apple's App Store policies
• We do not provide refunds for disputes over credit usage

6.3 Account Termination & Credits

• If your account is terminated for violating these Terms, remaining credits are forfeited
• Unused credits cannot be transferred to other accounts
• We are not responsible for lost credits due to account access issues

7. Intellectual Property Rights

7.1 Our IP

• HERE, its design, features, and content are owned by JimmyLabs
• All trademarks, logos, and brand elements are protected by law
• You have no ownership rights to HERE or its features
• Unauthorized use of our intellectual property is prohibited

7.2 Your IP

• You retain ownership of content you create
• By posting, you grant us permission to use, store, and display your content
• We do not claim ownership of your personal data or messages

8. Disclaimer of Warranties

HERE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

• We make no warranties that HERE will be uninterrupted, error-free, or secure
• We make no warranties regarding the accuracy of user information
• We do not guarantee matches will result in meaningful conversations
• We are not responsible for user behavior or interactions
• You use HERE at your own risk

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• JimmyLabs shall not be liable for indirect, incidental, special, or consequential damages
• JimmyLabs shall not be liable for lost profits, data, or business interruption
• JimmyLabs shall not be liable for user interactions or disputes
• JimmyLabs shall not be liable for third-party services or content
• Our total liability shall not exceed the amount you paid in the past 12 months

10. Indemnification

You agree to indemnify and hold harmless JimmyLabs from any claims, damages, or costs arising from:

• Your violation of these Terms
• Your use of HERE
• Your content posted on HERE
• Your interactions with other users
• Your violation of any applicable laws

11. Account Termination

11.1 Termination by Us

We may terminate your account immediately if:

• You violate these Terms
• You engage in illegal activity
• You are found to be under 18 years old
• You engage in harassment, fraud, or abuse
• We believe termination is necessary for safety or legal compliance

11.2 Termination by You

• You may delete your account at any time through app settings
• Account deletion is permanent and cannot be undone
• All your messages and profile data are permanently deleted within 30 days
• Unused credits are forfeited upon account deletion

11.3 Effect of Termination

• You lose access to HERE and your account immediately
• You cannot use a new account to circumvent restrictions
• Provisions regarding liability and indemnification survive termination

12. Safety & Third-Party Content

12.1 User Safety

• Meet safely in public places when meeting other users
• Never share personal information like home address or workplace
• Report suspicious or dangerous behavior immediately
• We are not responsible for user-to-user interactions or safety

12.2 Third-Party Services

• HERE uses services provided by Apple, Firebase, and other third parties
• We are not responsible for third-party service outages or issues
• Third-party terms and privacy policies apply to those services

13. Modifications to Service

• We reserve the right to modify or discontinue HERE at any time
• We may modify features, pricing, or functionality
• We will provide notice of material changes when possible
• Continued use after changes constitutes acceptance

14. Modifications to Terms

• We may update these Terms at any time
• Material changes will be notified through the app
• Your continued use constitutes acceptance of updated Terms
• You are responsible for reviewing Terms periodically

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of South Korea, without regard to conflict of law provisions.

15.2 Jurisdiction

You agree that any disputes shall be subject to the exclusive jurisdiction of the courts of South Korea.

15.3 Informal Resolution

Before initiating legal action, we encourage you to contact us to attempt to resolve disputes informally.
