End User License Agreement (EULA)

1. Grant of License

JimmyLabs grants you a limited, non-exclusive, non-transferable, revocable license to download and use HERE for personal, non-commercial purposes, subject to this Agreement and all applicable laws.

• This license is personal to you and may not be transferred or assigned
• You may use HERE only on devices that you own or control
• You must comply with all terms and conditions of this Agreement
• We may revoke this license at any time for violations of this Agreement

2. Usage Restrictions

You agree NOT to:

• Reverse Engineer: Decompile, disassemble, or reverse engineer the app
• Redistribute: Copy, distribute, or sublicense the app to third parties
• Modify: Alter, modify, or create derivative works of the app
• Remove Notices: Remove or alter any copyright, trademark, or proprietary notices
• Illegal Use: Use the app for any illegal purposes or in violation of any laws
• Commercial Use: Use the app for commercial purposes without express written permission

3. User Content

3.1 Ownership

• You retain ownership of all content you create and share on HERE
• You are solely responsible for your content and the consequences of sharing it
• You must have all necessary rights to share your content

3.2 License to Company

• By posting content, you grant JimmyLabs a worldwide, royalty-free license to use, store, display, and process your content
• This license is necessary for us to operate HERE and provide services to you
• We may use your content for service improvements and analytics
• We will not sell your content to third parties

4. Prohibited Conduct

You agree NOT to use HERE to:

• Explicit Content: Share sexually explicit, graphic, or obscene content
• Harassment: Harass, bully, threaten, or intimidate other users
• Hate Speech: Share content that promotes hate, discrimination, or violence
• Threats: Make threats of violence or harm to others
• Spam: Send unsolicited messages, advertisements, or spam
• Scams: Attempt to defraud or deceive other users
• Sexual Content: Share or solicit sexual content or services
• Impersonation: Impersonate any person or entity
• Illegal Activities: Engage in or promote illegal activities
• Minor Safety: Share content that exploits or endangers minors

5. Content Moderation

• Active Monitoring: We actively monitor content for violations of this Agreement
• Automated Systems: We use automated filtering and AI detection to identify prohibited content
• Human Review: Reports are reviewed by our moderation team
• 24-Hour Response: Violations are addressed within 24 hours of detection
• Content Removal: We will remove any content that violates this Agreement
• User Reports: Users can report content and users that violate our policies

6. Account Suspension and Termination

6.1 Immediate Termination

We may immediately terminate your account for serious violations including:

• Sharing explicit sexual content
• Harassment or threats of violence
• Content endangering minors
• Repeated violations after warnings
• Fraud or scam attempts

6.2 Progressive Discipline

For other violations, we follow a progressive approach:

• First Offense: Warning and content removal
• Second Offense: 7-day account suspension
• Third Offense: 30-day account suspension
• Fourth Offense: Permanent account ban

6.3 Effect of Termination

• All licenses granted under this Agreement immediately terminate
• You must cease all use of HERE
• Remaining credits are forfeited
• Account data will be deleted according to our Privacy Policy

7. Intellectual Property Rights

7.1 Company Ownership

• HERE, including all source code, designs, features, and functionality, is owned by JimmyLabs
• All trademarks, logos, and brand elements are protected by law
• You have no ownership rights to HERE except the limited license granted herein
• Unauthorized use of our intellectual property may result in legal action

7.2 Your Rights

• You retain all rights to content you create
• We do not claim ownership of your personal data, messages, or profile information

8. Disclaimer of Warranties

HERE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

• No Warranty of Availability: We do not warrant that HERE will be available at all times
• No Warranty of Quality: We do not warrant that HERE will be error-free or secure
• No Warranty of Results: We do not guarantee any specific results from using HERE
• User Responsibility: You use HERE at your own risk

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• JimmyLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• JimmyLabs shall not be liable for any loss of profits, data, or business interruption
• JimmyLabs shall not be liable for user conduct or interactions with other users
• Our total liability shall not exceed the amount you paid to us in the past 12 months

10. Governing Law

• This Agreement is governed by and construed in accordance with the laws of South Korea
• Any disputes shall be subject to the exclusive jurisdiction of the courts of South Korea
• The United Nations Convention on Contracts for the International Sale of Goods does not apply
